IERC Membership Waiver

All participants in the Inland Empire Running Club (“IERC”) and related events (“courses”) are required to assume all risk of participation in the Running Club/Training Program by signing this general release agreement.   Anyone age of 13 to 18 requires parent/legal guardian signature on this waiver and be present while participating in any IERC training event.  No child under the age 13 can train with the club and cannot be left at the school while parents participate in any training runs.  The undersigned athlete (“Athlete”) on behalf of him/herself and on behalf of Athletes personal representatives, assignees, heirs, executors, hereby fully and forever releases, waives, discharges and covenants not to sue Inland Empire Running Club, whose property and/or personnel are used.  IERC and its subsidiaries, and all other sponsoring or co-sponsoring companies or individuals related to IERC (collectively) “Releases” from all liability to the Athlete and his/her personal representatives, assigns, heirs and executors, for all loss(es) or damage(s) and any and all claims or demands therefore, on account of injury to the Athlete or property or resulting in death of the Athlete, whether caused by the active or passive negligence of all or any of the Releases or otherwise, in connections with the Athlete’s participation in the Running Club/Training Program.  The Athlete represents and warrants that he/she is in good physical condition and is able to safely participate in the IERC.  The Athlete is fully aware of the risk of hazards inherent in participating in the IERC and hereby elects to voluntarily participate in the IERC, knowing the associated risks with IERC.  The Athlete hereby assumes all risk for all loss(es), damage(s), or injury(ies) that may be sustained by him/her while participating in the IERC.  The Athlete agrees to use his/her name and photograph in broadcast, newspapers, brochures and other media without compensation.  The Athlete acknowledges that membership dues/entry fee is non-refundable and non-transferable.  In the event the Program is delayed or prevented by reason of fire, or threatened or actual strike, labor difficulty, work sabotage, insurrections war, public disaster, flood, unavoidable casualty, acts of God or the elements (including without limitation, hurricanes, tornadoes, earthquakes, or any cause beyond the control of the IERC there shall be no refund of the membership dues/entry free or any other cost of the Athletes in connections with the IERC.  In the event of a medical emergency during the training the Athlete hereby grants to IERC and medical directors of the IERC and their agents, affiliates, and designees’ access to all medical records (and physicians) as needed and authorizes medical treatment as needed.  The Athlete also agrees to reimburse any cost incurred by IERC and/or a third party providing medical assistance.  The Athlete warrants that all statements made herein are true and correct and understands that Releases are relied on allowing the Athlete to participate in the IERC.  The Athlete understands that all IERC fees are non-refundable.  I further agree to abide by the California Department of Public Health (CDPH) and the San Bernardino County Department of Public Health (SBDPH) public health orders and recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other communicable diseases. I assume all such risks being known, appreciated, and accepted by me.
